In accordance with Articles 15 and 16 of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), we hereby inform you that Diego Hernández García, hereinafter referred to as Hega for the purposes of this notice, with registered address at Guillermo Prieto 101-B, Colonia Guadalajarita, ZIP Code 28030, Colima, Mexico, is responsible for collecting your personal data, the use given to it, and its protection.

1. What information do we collect?
The personal data you voluntarily provide through this website (“Portal”) may include: full name, address, email address, phone numbers, wedding date, wedding location, and mobile number, for consultation purposes.

2. What do we use your information for?
The personal data we collect will be used solely for the following purposes:
(a) Identification,
(b) Statistical and internal analysis,
(c) Information and contact purposes,
(d) Customer service and support,
(e) To contact you via email or telephone in relation to the above purposes.
In collecting and processing your personal data, we comply with all principles outlined in the Law (Article 6): legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility.

3. Who do we share your information with?
Hega may hire one or more third-party service providers to manage and operate both this Portal and the personal data collected through it or by any other means. Therefore, your data may be transferred to said third parties for non-commercial purposes. Under no circumstances will we sell, rent, or market your personal information to third parties without your prior consent.

The personal data you provide may be compiled and stored in a database exclusively owned by Hega. Please note that we may use “cookies” to confirm your identity, personalize your access to this Portal, and track your use of the site solely to enhance your browsing experience and the site’s functionality. These cookies do not collect personal data in terms of the Law. This Portal may contain links to external sites whose content and privacy policies are not the responsibility of Hega, and users are therefore subject to the privacy policies of those external sites.

4. What security measures do we use to protect your personal data?
We have implemented administrative, technical, and physical security measures to protect your personal data. These same standards are required of our service providers.

Hega is committed to taking the necessary steps to protect the information collected, using security technologies and access control procedures to prevent unauthorized access, use, or disclosure—for example, storing personal data on servers located in Data Centers with restricted access. For online submissions, we also use security technologies to protect the personal data transmitted electronically. However, no system that is not entirely under our control and/or relies on the internet can guarantee absolute security.

5. Who is responsible for handling your personal data?
The department responsible for managing personal data on this Portal (www.hegafilms.com) is the “Personal Data Department.” The contact email is listed in section 6.

6. How can you exercise your ARCO rights and revoke your consent?
Data subjects may exercise their ARCO rights (Access, Rectification, Cancellation, and Opposition) or revoke the consent given to Hega by sending a request to the Personal Data Department at: hegafilms@gmail.com
The request must include at least the following:
(a) Full name and address or another means of communication,
(b) Documents proving identity or legal representation,
(c) A clear and precise description of the personal data and the rights being exercised,
(d) Any additional information that may help locate the personal data.

Hega will inform you via email, within no more than twenty (20) days from the date the request was received, of the decision taken. If appropriate, the request will be fulfilled within fifteen (15) days following the response.
For access requests, once identity is verified, the requested data will be sent via email. These timeframes may be extended once for the same period if circumstances justify it.

You may also revoke your consent for the processing and use of your personal data at any time by the means mentioned above. Upon your request to confirm the end of processing, Hega will respond expressly via the same means and within the same timeframes. If no response is given within the legal timeframe, you may initiate an ARCO rights protection procedure with Mexico’s National Institute for Transparency, Access to Information and Protection of Personal Data (INAI).

7. When can you exercise your ARCO rights?
Under the LFPDPPP, from June 25, 2020, you may submit a request to exercise your ARCO rights. If Hega does not respond within the legal timeframe, you may initiate an ARCO protection procedure with INAI.

8. Changes to the Privacy Notice
We reserve the right to change this Privacy Notice at any time. Any changes will be communicated to users by posting a visible notice on our Portal. For your safety, please review this Privacy Notice periodically.

9. Email communications and advertising
By submitting your data through any form on www.hegafilms.com, you agree to receive emails about content updates, promotions, and newsletters. You also consent to your email address being used in a “lookalike audience” by Facebook advertising algorithms to find new potential clients with similar interests.

10. Other applicable regulations
Laws and regulations in other countries may require different protections for personal data collected online. Hega is based in Colima, Mexico, and all matters related to this Portal are governed by Mexican law. If you are located outside Mexico and contact us, please be aware that your information will be transferred to Mexico, and by providing it, you consent to this transfer and accept this Privacy Notice.
